Yes I would if I were you. I would also consider to extend the Apple Care, but it really depends on you.
I don't think Apple would give you a new one if there is a trackpad problem. I am not sure tho.

You gotta make it happen in front of them, if it doesn't happen all the time, I would recommend you to take a video of it when it happens, and show it to them.
